1. All orders made by you will be confirmed by Jware and are without commitment until you have received an acknowledgement of receipt of the order from Jware in the form of a Pro-Forma invoice. At this time Jware will require further confirmation by you that the order and subsequent Pro-forma invoice are correct and then shipment will be made immediately if payment in by cash on delivery method or once full payment in received if by bank transfer method.

2. Jware will replace any damaged goods if they are returned immediately via the courier that delivered them with a returned goods receipt. In this case then Jware will replace the damaged goods within 48 hours. For all other claims of damaged goods Jware does not accept liability but will review each case, on a case-by-case basis, if a request for replacement of the goods is received within 24 hours of their delivery either by fax or email, with the nature and extent of the concerning defect/damage goods, clearly stated in the request and so long as the goods are returned within 30 days to:

3. If Jware is of the opinion that a complaint is justified, it is obliged only to deliver replacement products as soon as possible without you being entitled to compensation for any damages. The costs of warranty consignments, repair and/or replacement will be paid by Jware.

4. The warranty referred to in this article will not be applicable in the event that the defect has been fully or partially caused by any incorrect, improper, careless or incompetent use and/or if you have made any modifications to the products.


5. Liability of Jware resulting from the delivery of defective products will be limited to direct damages up to the amount of the price stipulated for the products concerned. Liability for indirect damages is excluded unless the damages are due to our willful intent or gross negligence.

6. Without prejudice to article 5, Jware will not be liable in the event that the defect has been fully or partially caused by any incorrect, improper, careless or incompetent use and/of if you have made any modifications to the products.
